The National Labor Relations Board is backing worker who was fired for griping about his boss on Facebook. In what the New York Times describes as a “ground breaking” case, the board has signaled that it considers criticism of a colleague protected speech whether it’s done at the water cooler or online. The case will be heard by an administrative law judge starting January 25th.
The law firm Morgan, Lewis and Bockius issued a briefing to clients on Monday, The firm cites a 1978 case which confirms that workers have the right to communicate to “improve their lot” through channels outside the company.
